You would have played or at least come across some of the Daily Fantasy Sports sites like DraftKings or FanDuel at some point. Until now, they were just another pay to play offering but as far as the state of Nevada is concerned, they are now going to be treated as gambling.
A. G. Burnett, the chairman of Nevada Gaming Control Board wrote to all the Daily Fantasy Sports sites and notified them of their legal position.
The entire notice sent by the Nevada Gaming Control Board is pretty lengthy, but here is the gist of it:
DFS constitutes gambling under Nevada law. More specifically, DFS meets the definition of a game or gambling game pursuant to Chapter 463 of Nevada Revised Statutes.
Moreover, because DFS involved wagering on the collective performance of individuals participating in sporting events, under current law, regulation and approvals, in order to lawfully expose DFS for play within the State of Nevada, a person must possess a license to operate a sports pool issued by the Nevada gaming Commission.
As you can see in the second half of the notice, these Daily Fantasy Sports sites are now going to need a gambling license if they wish to continue doing business in the region.
