Sega Agrees to Pay $1.25 Million in Aliens: Colonial Marines Lawsuit

Sega of America has agreed on a $1.25 million payment to settle a class-action lawsuit that was brought against it and Gearbox Software last year for false advertisement.

The decision is still pending in court and if the approval is given then the settlement will clear Sega of America of any further litigation. Of the $1.25 million payment, $312,500 will be used to cover attorney fees for the plaintiffs, $200,000 will be used to cover the cost of administration, $2,500 will go to the plaintiff, and the rest will be used to pay eligible customers who purchased the game.

Those who purchased the game before February 13, 2013 will have to fill out a three-question claim form to receive their payment back. Aliens: Colonial Marines was a disaster and even that’s putting it mildly.

The game’s original showcasing at E3 and other trade shows was pretty impressive and gained our attention.

However, the final product was far from what we had seen and far from what was promised to us. It also didn’t help matters that reviews for the game were set on hold until the release day. Hence many ended up purchasing the game, only to be left dumbfounded and disappointed.

Following the game’s release, a suit was filed against the developer and publisher in April 2013 by Roger Damion Perrine and John Locke on behalf of a class. The suit stated that Gearbox and Sega falsely advertised the game and hence committed fraud.

Aliens: Colonial Marines ended up as a game which was visually inferior, featured wonky AI, missing textures, missing entire levels even and had a good batch of bugs.

According to court documents though, Sega continues to deny an wrongdoing and is only settling to avoid the continued cost of fighting.
